FresiaExpress ("Company," "we," "us," "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you use the FresiaExpress mobile application ("App"), website, or related services (collectively, the "Platform").

By using FresiaExpress, you consent to the data practices described in this policy.

We collect different types of information depending on whether you are a Customer, a Driver, or simply browsing.

A. Information You Provide to Us

  • Account Information: Name, email address, phone number, password, profile photo (optional).

  • Payment Information: Credit/debit card details, digital wallet info, billing address (processed by secure third-party payment processors).

  • Identity Verification (for Drivers): Government ID, driver’s license, vehicle registration, insurance certificate, tax ID number.

  • Customer Support Communications: Any information you share when contacting us.

B. Information Collected Automatically

When you use the App, we automatically collect:

  • Location Data: Precise or approximate real-time location from GPS, IP address, or Wi-Fi (required for delivery matching and tracking).

  • Device Information: Device model, operating system, unique device identifiers, mobile network information.

  • Usage Data: App interactions, features used, pages viewed, time spent, clicks, and referral URLs.

  • Transaction Data: Order details, pickup and drop-off locations, delivery status, timestamps, and amounts paid.

  • Communications Data: Messages exchanged between Customers and Drivers via the App (but we do not store content longer than necessary).

C. Information from Third Parties

  • Map and routing services (e.g., Google Maps) to provide navigation and estimated times.

  • Background check providers (for Driver screening, where required by law).

  • Social media platforms (if you log in via Facebook, Google, etc.).

3. How We Use Your Information

We use your personal information for the following purposes:

A. Between Users (as necessary for delivery)

  • To Drivers: When you place an order, the Driver receives your name, pickup location, delivery address, and phone number (masked where possible).

  • To Customers: When a Driver accepts an order, the Customer receives the Driver’s name, photo, vehicle info, and real-time location during delivery.

B. With Service Providers

We share data with third parties who help us operate the Platform, such as:

  • Payment processors (Stripe, PayPal, Mercado Pago, etc.)

  • Cloud hosting providers (AWS, Google Cloud)

  • Customer support software

  • Background check services (for Drivers)

  • Mapping and analytics providers (Google Maps, Firebase)

These providers are contractually bound to protect your data and may not use it for any other purpose.

C. For Legal and Safety Reasons

We may disclose your information if required to:

  • Comply with a subpoena, court order, or legal process.

  • Enforce our Terms and Conditions.

  • Protect the safety, rights, or property of FresiaExpress, our users, or the public.

  • Investigate fraud or illegal activity.

D. Business Transfers

If FresiaExpress is involved in a merger, acquisition, or sale of assets, user information may be transferred as part of that transaction. You will be notified via the App or email.

5. Your Privacy Rights

Depending on your location (e.g., EU, California, Brazil, Colombia, Mexico), you may have the following rights:

  • Access: Request a copy of the personal data we hold about you.

  • Correction: Update inaccurate or incomplete information.

  • Deletion: Request deletion of your data (subject to legal retention requirements).

We implement reasonable administrative, technical, and physical safeguards to protect your information, including:

  • Access controls and authentication for internal systems.

  • Regular security assessments and monitoring.

  • Masking of phone numbers and addresses where possible.

However, no method of transmission over the Internet is 100% secure. You use the App at your own risk.

8. Children's Privacy

FresiaExpress is not intended for children under 18. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected such data, we will delete it immediately.

9. International Data Transfers

If you use FresiaExpress outside of the country where our servers are located, your data may be transferred across borders. We ensure appropriate safeguards (e.g., Standard Contractual Clauses) are in place to protect your data.

10. Cookies and Similar Technologies

We use cookies, SDKs, and similar technologies to:

  • Keep you logged in.

  • Remember your preferences.

  • Analyze App usage and crash reports.

  • Serve relevant offers (with your consent where required).
